The IMAGINE Experience Booking Conditions
1. Introduction
These Booking Conditions (the "Conditions") constitute a legally binding agreement between you (the "Participant") and Extended Family, LLC ("we," "us," "our") governing the booking and participation in our travel experiences (the "Experience"). By booking an Experience with us, you agree to comply with and be bound by these Conditions.
2. Booking and Deposit
2.1. To secure a reservation for an Experience, a non-refundable deposit of 20% of the total Experience cost (the "Deposit") is required at the time of booking.
2.2. The balance of the Experience cost must be paid in full no later than 30 days before the commencement of the Experience (the "Final Payment Date"). Failure to make the Final Payment by the Final Payment Date may result in cancellation of the Participant's booking and forfeiture of the Deposit and any payments made up to 30 days before departure.
2.3. Bookings made within 30 days of the Experience commencement date require full payment at the time of booking.
3. Payment Methods
3.1. Payments are processed through our payment operator WeTravel, which accepts various payment methods.
3.2. All payments must be made in USD. Any transaction fees associated with payment methods are the responsibility of the Participant.
4. Cancellation Policy
4.1. Cancellation by Participant
4.1.1. Cancellations made more than 90 days before the Experience commencement date: The Deposit is transferable to a future Experience within 12 months of the original booking date.
4.1.2. Cancellations made between 30-90 days before the Experience commencement date: 50% of the total Experience cost is refundable minus the Deposit.
4.1.3. Cancellations made less than 30 days before the Experience commencement date: No refunds will be issued.
4.2. Cancellation by Extended Family
4.2.1. In the event that we cancel the Experience due to circumstances beyond our control, including but not limited to natural disasters, political instability, or other force majeure events, Participants will be offered a full refund or the option to transfer their Deposit to a future Experience.
4.2.2. We reserve the right to cancel an Experience if the minimum number of Participants (8) is not met. In such cases, Participants will receive a full refund or the option to transfer their Deposit to a future Experience.
5. Minimum Age Requirement
5.1. Participants must be at least 21 years old to book an Experience.
5.2. Participants under the age of 21 may join an Experience if accompanied by a legal guardian who accepts full responsibility for the minor's actions and well-being.
6. Travel Insurance
6.1. All Participants are required to obtain comprehensive travel insurance that covers experience cancellations, medical expenses, personal injury, and loss or damage to personal property.
6.2. Proof of insurance must be provided to us 30 days prior to the Experience commencement date. Failure to provide such proof may result in cancellation of the Participant's booking without refund.
7. Health and Safety
7.1. Participants are responsible for ensuring they are in sufficient health and fitness to undertake the Experience and any associated activities.
7.2. Any pre-existing medical conditions or dietary restrictions must be disclosed at the time of booking. Failure to disclose such information may result in the Participant being unable to participate in certain activities without refund.
8. Passports
Participants are responsible for obtaining and maintaining all necessary travel documents required for the Experience. While we may offer to help facilitate visas or other entry documents, not including a passport, for certain experiences we cannot guarantee that your visa or entry authorization will be successful.
9. Code of Conduct
9.1. Participants are expected to conduct themselves in a respectful and considerate manner towards other travelers, staff, and local communities in which we visit.
9.2. We reserve the right to remove any Participant from the Experience if their behavior is deemed inappropriate, disruptive, or illegal according to local law without refund.
10. Liability
10.1. We shall not be liable for any injury, loss, damage, accident, delay, or irregularity which may be occasioned by reason of any defect in any vehicle or other mode of transportation or through the acts or defaults of any company or persons engaged in conveying the Participant.
10.2. We shall not be responsible for any direct, indirect, consequential, or incidental damage, injury, loss, accident, delay, or irregularity of any kind which may be occasioned by reason of any act or omission beyond our control, including but not limited to any willful or negligent act, failure to act, breach of contract, or violation of local law or regulation of any third party.
11. Changes to Itinerary
11.1. While we endeavor to adhere to the planned itinerary, changes may occur due to weather, local conditions, or other factors beyond our control.
11.2. We reserve the right to make any necessary adjustments to the itinerary to ensure the safety and enjoyment of our Participants.
12. Governing Law
These Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, USA. Any disputes arising out of or in connection with these Conditions shall be subject to the exclusive jurisdiction of the courts of the State of Nevada.
